By purchasing traffic services from DFYAffiliateTraffic, operated by Open Channel Media LLC, you (the “Customer”) agree to these Terms of Service. Please read them carefully, as they outline your rights and responsibilities. By placing an order, you acknowledge and accept all terms herein.

2. Description of Service
DFYAffiliateTraffic provides high-quality traffic services to affiliate marketers. We ensure the delivery of traffic as purchased, but make no guarantees regarding specific results, such as leads, sales, or conversions. Performance outcomes are influenced by factors beyond our control, including your offer, landing page quality, and other variables.

3. Prohibited Content
You are prohibited from using our service for content that is misleading, deceptive, illegal, or promotes unethical practices. We strictly forbid traffic orders related to:

Adult or pornographic content
illegal substances, or activities
Hate speech, discrimination, or violence
Copyrighted or trademarked content without permission
Any other content deemed inappropriate or harmful by DFYAffiliateTraffic

We reserve the right to refuse, cancel, or refund any order that violates these content guidelines.

4. Traffic Delivery & Quality Disclaimer
While we aim to begin traffic delivery within 24 hours, delivery times may vary based on the package and other factors. DFYAffiliateTraffic guarantees delivery but does not guarantee the quality, interest level, or specific demographic fit of traffic beyond specified offerings (e.g., Tier 1 or USA-only traffic). We are not liable for the customer’s results, such as leads or sales, and make no assurances on the effectiveness of the traffic with specific audiences or offers.

5. No Guarantee of Results
DFYAffiliateTraffic solely guarantees traffic delivery as purchased. We do not guarantee any specific outcomes, such as lead generation, sales, or conversions. Customer acknowledges that traffic results are influenced by variables beyond DFYAffiliateTraffic’s control and accepts all associated risks.

6. Liability for Third-Party Platform Actions
DFYAffiliateTraffic is not responsible for actions taken by third-party platforms (such as Google or Facebook) resulting from traffic delivered by our services. This includes, but is not limited to, ad disapprovals, account suspensions, or compliance-related issues encountered due to the content or nature of your offer.

7. Refund Policy
All sales are final. Given that traffic services are non-returnable once delivered, refunds are not provided under any circumstances. Customers are strongly encouraged to thoroughly evaluate our services before purchasing. Refunds will only be issued if DFYAffiliateTraffic cancels an order due to a violation of these Terms.

8. Service Interruption & Force Majeure
DFYAffiliateTraffic is not responsible for any delays or interruptions caused by unforeseen circumstances beyond our control, including but not limited to technical failures, natural disasters, or governmental actions. In the event of such interruptions, DFYAffiliateTraffic will endeavor to resume service as quickly as possible but makes no guarantees regarding specific recovery timelines.

9. Modification of Services and Pricing
DFYAffiliateTraffic reserves the right to modify services, terms, and pricing at its sole discretion. Any changes will be posted on our website, and continued use of our services signifies acceptance of these modifications. Customers should review the Terms of Service periodically to stay informed of any changes.

10. Limitation of Liability
DFYAffiliateTraffic’s liability is strictly limited to the amount paid by the Customer for the specific service in question. Under no circumstances shall DFYAffiliateTraffic, its owners, employees, or affiliates be liable for indirect, incidental, or consequential damages arising from the use of our services.

11. No-Refund Policy for Specific Situations
Our no-refund policy extends to scenarios where performance issues result from factors on the Customer’s end, such as:

Website downtime or landing page malfunctions
Non-functioning tracking tools on the Customer’s website
Changes or issues in third-party platforms affecting traffic delivery

DFYAffiliateTraffic is not responsible for verifying the functionality of external tools, platforms, or websites owned by the Customer.

12. Indemnification
The Customer agrees to indemnify and hold harmless DFYAffiliateTraffic, Open Channel Media LLC, and all associated parties from any claims, damages, liabilities, costs, or expenses arising from the use of our services. This includes, but is not limited to, claims related to the Customer’s offer, website content, or misuse of our services.

13. Dispute Resolution & Arbitration
All disputes arising from the use of DFYAffiliateTraffic services will be resolved through binding arbitration, conducted by the American Arbitration Association (AAA) in Cheyenne, Wyoming, unless otherwise specified by Open Channel Media LLC. Each party will bear its own costs, and the arbitrator’s decision will be final. Legal action must be brought individually and not as part of a class action. Claims must be filed within one year of the cause of action, or they will be permanently barred.

14. Governing Law & Venue
These Terms of Service are governed by the laws of the state of Wyoming, without regard to conflict of law principles. Cheyenne, Wyoming, is the exclusive venue for all legal proceedings, unless otherwise specified by Open Channel Media LLC.
